Insured vs Insured Exclusion

A policy exclusion that bars coverage for claims brought by one insured party against another insured under the same policy. In law firm malpractice policies, this exclusion prevents partners from filing malpractice claims against each other under the firm's own policy. The exclusion exists because carrier concerns about collusive claims between related parties. Some policies include carve-backs for employment-related claims between the firm and its attorneys, and D&O policies often have a broader version of this exclusion.
