Duty to Indemnify
The insurer's obligation to pay settlements, judgments, and other covered losses on behalf of the insured when a claim falls within the policy's coverage terms. Unlike the duty to defend, the duty to indemnify is determined by the actual facts of the claim and applies only to covered losses up to the policy limits.
